Well it depends on what dates the repayment of Eddie Davies loan falls due. As long as KA meets the deadline he still retains ownership of the club, providing of course he hasn't lost it under Administration/Liquidation, sold it, or come to some deal to leave with the other major creditors first. As described above, he has personally borrowed £5 million put at risk in the Club. Regardless of the lender, that is his money. If he has mitigated the risk of losing a £ on it, that's probably fairly shrewd. It's nonsense to keep saying he's not put anything in though. If you buy a car with a loan you still owe the money. That's not factually correct, plenty companies go into Administration and enter out of it as the same owners - just that during Administration agreements with their major creditors have been reached for them to take a 'haircut' (agree to take a reduction on what they are owed) in order for the company to be solvent and carry on trading again. I would have thought that any act of default other than non payment - such as administration of Burnden Leisure , would give Eddies trustees the right to date both documents and remove KA from any ongoing involvement .
