I thought Affray was more than 3 peeps, could well be wrong though.

you're right, but they might be counting the fact he was part of a group although the others were trying to break it up in the main from my memory of the video.

 

presume the other two they are charging were the lads he twatted, as they seemed to instigate it, so a scrap between three people may be classed as affray.

At the outset the clear choices were:

to continue to select him until any charges were brought,

to suspend him until the investigation and any resulting court action were complete.

 

What they have managed to do is neither. The only clear effect of their chosen course was to reduce the chances of performing well in the Ashes from moderate to near-zero.

Aggers was on earlier. He put forward a belief (not fact) that the ecb didn't want the storm and baggage that would have followed him had he gone to Australia.

Moreover, that they had no idea of if he would be charged and if he would have to come home during the series. Thus it would be too disruptive if he had gone.

 

I think now it has become a bit clearer, the ecb are happy for him to go; he's wanting to have his day in court to clear his name and they seem to be happy to go along with innocent until proven guilty.

that's the only reasonable conclusion to be fair.

 

it might have been better if they'd stated those reasons in the first place though. (if it's true)

What perplexes me is that he/not be guilty, but has let the team down, by being out late at night in the middle of a series and I don't think he's been punished for that
