Owt is possible. But we are all using either speculation or partially educated guesses whereas in truth we don’t know.

I haven’t read the detail about the injunction / court case, but was the SPA between Ken and Bassini (for which Bassini is claiming specific performance) just to purchase the club, or was it for everything - club, hotel, land etc?

If Ken was selling lock stock and barrel to Bassini, then Bassini’s injunction / court action would presumably have applied to the hotel just as much as the club?

So , if Fv dont buy the club cos they cant get the hotel , and the hotel gets sold to highest bidder (not FV) and the club folds ...what use is the hotel attatched to a un owned and un used football stadium that may well be demolished after liquidation ? 

Does that make any sense ? not the principal but my terrible grammar ?

Inner circle still under injunction - does that impact their legal ability to agree to the deal perhaps? Possibly injunction has some impact on Inner circle and the charge on the hotel?

For all we know the hotel bid from Kamani might be contingent on the club survival. It might be that they want the land and happy to liquidate.

Depends who owns the hotel as the injunction now rests on ICI? Sluffy will advise

Indeed - Sluffy will no doubt be typing his evening update at the minute. 

I haven't looked at the group structure closely enough to know which entity owns the hotel and whether it was caught by the original injunction (or the current one). Nor do I know which companies were parties to the SPA with Bassani. Just a hypothesis as to how the hotel is affected by this.

Re the injunction: am I right in thinking that EDT placed the club in administration and ICI placed the hotel in administration?

If I am, and if I'm also right that the legal action is now solely between Bassini and ICI, could it be that the reason why the sale of the club can proceed but the sale of the hotel can't is because it wasn't placed into administration by the defendant company?

yes! but because FV need the hotel, it by default scuppers the club sale to FV. What an almighty fuck up.

How can the club admins have given FV preferred bidder status if they obviously couldnt prove funds, given that they need the hotel that they didn't and still dont have

It's not that common to have a contract race with two bidders, but it happens from time to time. It means you can negotiate contracts with more than one party, putting pressure on both to swiftly agree terms. The first party to agree the contract would (normally) exchange with the seller. It looks like the administrators are giving FV every opportunity to do the deal, if they can match Boo Hoo's terms.

Meaning FV will be told kamanis price?

If so, let's say they can do it, what then, Quantuma get kamani to up his offer?

Doesn't sound very promising in that scenario

This remains the million dollar question and I suspect the very substance behind bassinis claims that the admins haven’t done their job properly. 

Either that or the other offers were horseshit but we shall never know  

murky murky world insolvency let me tell you!
