Only because Madrid forgot to write into the contract that he can't. I'll bet Chelski remembered!

From what Maldini said, I think Crespo is down the pecking order anyway. They have Jon Dahl Tommasson, Shevchenko and Inzaghi. Not sure if, how long for, or what the injury situation is with the other 3.
