A few of my mates have been sacked, some suspended on full pay, for gross misconduct because the tracker readings do not tally with time sheets. The thing is the company have looked back to November to get them.

 

Some of the readings are wrong as the tracker don't seem to show the van picking up one of the lads. Can anyone itk tell me if they can legally sack people if there is a obvious flaw in the system?

depends how strong the union is with the firm, now seeing they allowed the trackers to be put in in the first place I'm getting the word pussies

I also forgot to put that they didn't sign any forms when the devices were installed. Our tracker at work picked me up doing 70mph down Plodder Lane when I was on the M62.

 

Because they ain't computer literate they've asked me to find out info and laws what may help their case.

These devices are hit and miss sometimes, they work on GPS and can not always be 100% reliable. I would think they had other evidence such as being seen or another employee's word.

They will need to look at their conditions of employment/rules and see how much evidence the company needs to get rid.Might be better speaking to a decent solicitor than take well meaning advice off here.

They're not really a "company". Well, not a well run one. :roll:

The company wouldn't of sacked someone by a one off, obviously its been a regular occurance and these fellas have been committing fraud by falsifying time sheets so they are bang to rights. Also the company own the vehicles so are well within their rights to have whatever fitted without the drivers consent
