Off-duty PC's fatal overtaking move

By Terry Morgan

AN off-duty policeman was attempting to overtake a line of traffic on his untaxed motorbike when it crashed at high speed into three pedestrians, killing a mother-of-three.

Bolton Crown Court heard how PC Damien Myerscough was thrown into the air when his powerful sports bike hit the side of a VW Golf as it turned from Church Street into Sumner Avenue, Ainsworth, shortly before 1pm on Good Friday last year.

The force of the collision sent his 998cc Yamaha machine ploughing into 43-year-old Lyndsay Oldham and two of her three teenage children, who were walking on the opposite side of the road.

The court heard the motorbike crashed into Mrs Oldham's back, causing her to fall head-first against a stone wall. Her daughter, Emma, aged 14, narrowly escaped being impaled on metal house railings while her 17-year-old brother, David, suffered a broken ankle.

The court was told while still at the crash scene, Myerscough, who worked for Greater Manchester Police's Tactical Aid Unit, was heard to say: "I'm doomed. That's my career gone. I'm a police officer."

Mrs Oldham had worked for Bury Council for almost nine years and was an IT service desk engineer. On the day of her death, she had celebrated her husband George's 57th birthday.

Following a lengthy accident investigation, Myerscough, aged 42, was charged with causing Mrs Oldham's death by dangerous driving, which he later denied.

Describing the moments before the fatal crash, Andrew Nuttall, prosecuting, said Myerscough's motorbike was not taxed, its chain was slack and had an illegal exhaust which had been fitted to make the machine sound louder.

Mr Nuttall said Church Street was the main route through Ainsworth. The jury of nine men and three women was told Myerscough was riding behind four cars, including the VW Golf, when he accelerated at excessive speed and pulled out.

The accident happened when the VW Golf, driven by hairdresser Aaron Willcock, turned right from the line of cars into Sumner Avenue.

Mr Nuttall said: "Myerscough was fixed on getting past the cars in front of him and was travelling so fast that he ploughed straight into the VW Golf. He was propelled into the air and over the Golf, crashing further down the other side of the road.

"The bike also flew up into the air and over the car and tragically crashed on to the back of Lyndsay Oldham who was on the pavement. She fell with the full force of this sports bike on top of her."

The court heard that Mrs Oldham was pronounced dead at the scene.

Myerscough, of Camden Close, Ainsworth, is still receiving treatment to repair his shattered left leg and sat in court in a wheelchair.

Do Golfs not have wing mirrors?

He will get a fine & a Ban

Isaac

For killing someone due to your crap driving you should get yourself landed with a prison term. No doubt he will get a ?200 fine and 6 points...

Bet he can get along with a walking stick.

The wheelchair will be a ploy to get sympathy.

There's crap driving and then there's driving like a dickhead.

Think I only missed this incident by minutes last summer.......

......are we to believe that the Golf was in the right to be turning - or did she make an illegal manoeuvre?

(ps. manoeuvre - now that is a tough cookie of a word - is it French?)

joliffe v hay;

A vehicle was driving along a major road intending to turn into a side road to the drivers right. A vehicle who was following, went to overtake the turning vehicle just as the turning vehicle turned into the side road.

70/30 in favour of turning vehicle.

It's manslaughter when all's said and done.

Send him down.

had it not been for the death I'd be rather pleased about the outcome of his manouvre, i.e. still in a wheelchair

not because he's a cop or untaxed

but feckin motorcyclists and their under/overtaking manouvres really f?ck me off

as do cyclists who think they know the rules of the road yet ride along without a helmet

f?ck em

Wonder if he's still on full police pay whilst enjoying his period of sickness.

Not forgetting the ridiculous sums of money we pay to give them special paths which they refuse to use and so clog up the roads used by drivers! Don't get me going on that one! I've had a window down with choice words incident or two with those nobbers!
