2. At that time, the clauses that have subsequently been found to break Rule U18 were in place. Meaning that WHUFC had no option but to let Joorabchian do as he pleased with Mascherano.

 

3. After the original independent commission the offending clauses were removed. This now means that Joorabchian cannot sell Tevez without WHUFC's agreement as we own his registration.

 

 

 

This is why currently Joorabchian and Magnusson are locked in talks. I'm 99% sure they will come to an agreement of sorts, thus avoiding going to court.

So in effect, the following could happen:

 

WHU could say to Kia Joorabchian to get fucked and leave Tevez warming the bench for the next three seasons unless they get a sizable transfer fee.

He then says, ok Mr Magnusson, I helped you along with the PL enquiry but now you are seriously pissing me off and im off to have a word with Sheff Utd's lawyers because we both know full well that the agreement that broke the rules is still in place.

 

Everyone knows that the agreement that broke the PL rules still applies, officially or unofficially and the whole thing is a farse. This whole Man Utd transfer is making the PL look like a right set of plebs, it was all supposed to have been sorted.

i assume Kias loan fee elsewhere will be more than you are paying so he will wnt the move.

One thing I don't understand about all of this. When a player comes to the end of his contract with a club, they do not hold on to his registration. Following the Bosman ruling such a player can choose to move to whichever club he wants.

 

So surely one of 2 things must apply right now:

 

1. Tevez signed a 2, 3, 4 or 5 year contract with West Ham last summer and West Ham are well within their rights to demand a fee for his registration

 

2. Tevez and West Ham do not have such contract (either because none was ever signed or because the agreement was for only 1 year) and Tevz is free to go play for whoever he wants

 

Am I looking at this too simplistically?
