Who gets done if a vehicle hasn't got tax?

 

The owner or the driver?

 

We've got a couple of contract hire vans, the hire fees includes RFL but we've not had them sent to us despite numerous attempts to get them.

 

We cant go the the post office for them because we dont have the ownership forms, just the insurance documents otherwise we would and knock it off next months bill.

 

So when the police pulls one over who gets in trouble?

I'm sure it's the owner.

 

But they can take the vehicle off the driver if it's over a month late.

It's actually 2 things.

 

It's the owners responsibility to tax it, the driver's responsibility to display a valid tax disc.

 

So both can be done.

 

I've got vague memories of being told this when driving a non taxed van of my dads.

However, if you pop round in your leather jacket and explain that you're packing heat, they'll probably drop the charges.

You can check whether the hire company have taxed it or not on DVLA'a website as long as you've got the registration mark, make and model.

 

If, as registered keeper, the hire company hasn't taxed them they're running a risk as the DVLA computer issues automatic fines if a vehicle isn't taxed/sorn'd/scrapped/exported.

 

That said it is the driver's responsibility to ensure the vehicle is taxed.

Technically, the driver is at fault, but the driver can't tax the van.

 

The leasing company get the tax disc reminder and it's their vehicle: therefore it's ultimately their responsibility.

 

If a copper / DVLA wanted to be stroppy, I suppose he could, but generally common sense should prevail.

 

Write to the leasing company about it and keep a copy on file, just in case.

 

As you already know, it does no harm to cover your own arse.

Withold payment of the vans. Tell the hire company that you haven't been able to use them due to no tax. Bet said discs will be in your hands first thing Monday.

It's a bit queer that your contract hire folks haven't sent new tax discs before the old ones run out. We've had contract hire cars and vans for years and we used to wonder how they could get a tax disc for the next 12 months a month before the old ones ran out but there you go, shmoke and mirrors an' all that.

 

TBH if you drive around in them and the tax has been paid then no copper or VOSA bloke will look twice at you as it's all down on their 'puter and on their ANPR shit but aye, if you park one up and any fecker spies your out of date tax disc then it's down to the owner of the vehicle. We used to worry about parking tickets etc. too but never got charged, I think our 'special' (i.e. welshist) contract hire blokes were of the old school persuasion, i.e they 'disappeared'.

 

The tickets that is, not the drivers.
