May 16, 20188 yr Pablo or I built a site which has all the useful stuff to follow, plus the PECR info. Read the info it’s fairly straightforward.
May 16, 20188 yr Any useful bods on here who can help...? Best advice is go to the regulators website, which is really helpful. Then, call them if you need. Again, really helpful.
May 16, 20188 yr Ask folk to opt in first time you're in touch. Give em an opportunity to fuck off at every subsequent contact. That's how I'm playing it anyway.
May 16, 20188 yr Missing a trick there depending on how you collect data or if you’re B2B The ICO is two blokes above a pub in Cheshire. All info is out there, you just need to read up, but as I say don’t forget to read the PECR stuff as well as this is helpful if emails are your main source of contact with customers.
May 16, 20188 yr It’s a bit of a headache, as we have to get alll 3000+ folk on our current emailing list to confirm they are opting in.....even though they’ve been getting stuff off us for yonks.
May 16, 20188 yr The ICO is two blokes above a pub in Cheshire. That may be the type of set-up in Edinburgh, Cardiff and Belfast, but the Wilmslow office is quite different nowadays

The unsubscribe/manage your preferences option needs to be incredibly obvious though.

Even if we get an enquiry, they've been added. We've just decided to pretty much start again....

May 16, 20188 yr It's helping me unsubscribe from loads of shite. I'm too lazy to open up emails I've no interest in anymore and click through the link etc. Most emails get deleted before I open them.
May 16, 20188 yr That may be the type of set-up in Edinburgh, Cardiff and Belfast, but the Wilmslow office is quite different nowadays I went in jan - when was the last time you paid them a visit Malc? Whilst it’s clearly not two blokes above a pub, it’s not the huge facility people think.

We've just decided to pretty much start again.... If you’re concerned about losing any repeat business then it might be worth working through to see how they were captured. If not then you were already breaking the existing legalisation - not that anyone has taken a blind bit of notice, hence the panic about the new laws - so you might as well go in with both feet and at least send a re-engagement email.

But remember, there isn’t an ICO detector van roaming around seeing if you’re compliant, someone has to complain. Anyway; here’s a breakdown for data controllers which follows some basic Q & As and also good practice on third party sharing. As I say, PECR allows you to get round some of the GDPR standard practice in certain communications. https://www.audiencedatasharing.org It’s based on audiences, but it’s all the same regulations and because it’s audiences it’s written for those with not much money, experience or indeed resources.
May 16, 20188 yr And here’s a standard data management policy you can download and follow: https://www.theaudienceagency.org/insight/sample-data-management-policy-structure And here’s a bit about PECR and how your ecoms might be a bit different from legitimate interest https://www.spektrix.com/blog/how-will-changes-to-pecr-impact-your-organisation Edited May 16, 20188 yr by Not in Crawley

When it was first set up it was pretty well as you describe, but currently they have 5 "executives", plus 5 advertised vacancies and an apparent shed load of departments.
May 16, 20188 yr I know, I’ve been. It’s still a bit comical though, ICO sounds like some glass fronted tower block in London rather than few people in wilmslow!

Someone has to complain, but the potential fines are HUGE Edited May 16, 20188 yr by boltondiver
May 16, 20188 yr 4% of global turnover I believe max fine is. Serious stuff It is, somebody will get collared for it I'm sure, and made an example of

May 17, 20188 yr Someone has to complain, but the potential fines are HUGE Indeed they are, but it’s all pretty simple to avoid. To be honest it’s all just good data practice anyway and folk should have been doing this for a while. After two years of working with it for my sector, I’m glad I don’t have to anymore As whilst it’s important, it’s bloody boring.
