My daughter works in HMV. Today she has been told to fuck off three times, somebody told her 'I hope you dont get paid', and some dick through cd's at her when she told him about the gift cards.

Why is it her fault? And would they have done it to a bloke?

They would have. Hhving worked at hmv for 8 years I have a lot of staff on my Facebook. People being spat at threatened etc.

What would happen if you took your CDs to the counter, offered to pay with the card, wrote the offer on paper after the refusal of the vouchers, left your name and address on it, and then walked out with them?

 

You have offered to pay for them and left what is under normal circumstances a reasonable method of settlement.

 

Surely it then becomes a civil matter rather than a criminal one.

 

Unless hmv clearly stated that the vouchers would be invalid in the event if administration at the time of purchase, them what could they do?

 

Also if they were sold recently (their downfall hasn't happened overnight) and they then kicked off with legal threats, the argument could be that they had been trading whilst technically insolvent when they sold them in the first place.

Nah, I thought the same thing this morning, but it's the kind of evil action (taking what you're owed) that would probably warrant the forensics team out to dust the giftcard, then give you a knock first thing tomorrow.

Theft (Shoplifting). If they tried to detain you (Arndale 'security') or there was a hullabaloo, they'd probably tag some Public Order offence on as well. Other charges (Affray? A.B.H. or G.B.H. ) may ensue, depending on if the 'security' had tried to physically prevent you (or anyone else who did this) from leaving.

 

i reckon' it's exactly the type of situation in which the O.B. usually decide to dispense with common-sense and to uphold the law to the letter.

That'd probably make it fall into the 'theft' category. If you gave the assistant the opportunity to inform the giftcard/voucher was no longer valid. The administrators have no obligation to honour the previous owners agreement.

 

If you made some excuse of trying to avoid the queue, claiming you weren't bothered about a receipt/change etc. as HMV are bust, so what's the point of a receipt? - you'd probably be let off. If you did it as some grand gesture or to prove a point, the managerment have probably been ordered from above to insist the police are involved and to press for criminal prosecution.

 

A lot of shoplifting prosecution depends on intent - if you've concealed the item, that's proof of intent to dishonestly obtain said item. Similarly if you've not the funds to pay for the item - if and when you're caught leaving the premises without paying.

 

If you walk out with an item in your hand, and are apprehended - it's possible to spin some bullshit story about it 'slipping your mind' or thinking someone has pickpocketed you etc. Anything that supports a claim you didn't intend to nick the item. That you left the store because of other reasons and intended to pay - it's difficult to prove otherwise (unless there's loads of CCTV of you doing this on other occasions).

 

In the case of leaving the giftcard/voucher on the counter and walking out, you'd be under no illusion the payment left wasn't acceptable (if you'd conferred with an assistant, or let on you were aware the giftcard had been made void) - then you'd be showing intent. You'd be aware of your dishonesty in the eyes of the law.

Clearly someone up the food chain thinks they can get away with the gift card scam but equally I reckon there would be someone of equal legal experience could have an equally sound counter argument should a prosecution for theft occur.

 

Who'd win is anyone's guess.

 

The company still exists, being in administration does not mean its dead and buried.

If the person who bought the gift card still has the receipt for it, surely they can return it?

 

Also, isn't the gift card now deemed unfit for its original purpose as per the Sale of Goods Act.

 

Either way, it's immoral at best.

I had a cursory look to see if anything like this was going on, it was a depressing indictment on people's apathy that loads of comments ran along the lines of:

 

"Well, I've chucked my gift vouchers in the bin, what use are they now?"

The cards are issued by a bank (RBS iirc) and are not the property of HMV, Basically you buy them from that bank the moneys held elsewhere and then HMV gets the money when they are redeemed. (this is why you can buy HMV vouchers from other places than hmv), As this money is held by the bank and HMV are in administration its beyond their control to get it back

 

We used to be able to do refunds but it's all down to the bank authorising it, and the sales of a giftcard doesn't go into HMV's coffers, or towards any targets.

 

One of the main reasons for the after xmas sales is to drag people in to redeem the egc's, however now they can't do that its causing issues.
