May 9, 201313 yr Can anyone on here help, I was letting out a property in 2007 and the tenants didn't pay the council tax, anyway bailiffs have been at my property today issuing a notice of distress, this is the first I have heard about the debt and they were saying I have 5 days to pay, this was after he Asked if he could film me whilst was stood at the door with my 5 month old son, which didn't go down to well, anyway he ended up posting the notice and put the inventory (goods they can take) as my missus car. The debt is £600 the cars value 8k

May 9, 201313 yr First thing bud, move the car to somewhere away preferably a garage like been said. Is the car on HP and is it in your name, i.e. does the name match the one on the distress warrant. They cant touch it if its onHP and not in the name of the debtor. You will need to have proof though such as an hp agreement. Do not sign anything or let them in, they may try and bluff you by ringing the coppers but if you keep civil they have no reason to. By law they have to be satisfied the car is yours, usually by doing a dvla check. The consumeractiongroup site is the place.

May 9, 201313 yr I have been letting property for years, and as Miami said the dept lies with the tenants just the same as it would be if they did not pay the utilities. You would only be liable if the property was empty, so dig out any paperwork you have relating to the tenants "ie" tenancy agreements, bank statements showing rental credits.
May 9, 201313 yr Who's name was on the council tax bill? That's who's name would be on the summons and importantly the liability order and who's responsible for the debt. Strange it's taken 5/6 years to get in touch and I would check when the liability order was granted. Council tax is not subject to the statute of limitations (ie 6 years). They have to obtain a LO within 6 years of the original demand but once they have it they can chase until the amount is either recovered or written off. Some local authorities, Liverpool notably, never write council tax debts off hence they have very large amounts outstanding. If they're uncooperative ring the local authority and make them aware of the fact their agents wouldn't provide the information.

May 9, 201313 yr Hughmungus, the car is in her name mate, so am not to worried about that, cheers Then if they come back and try and clamp it have the log book ready to show them, if they don't accept that then a solicitor will charge a tenner for a statement of declaration saying it isn't yours which you can give them. How anyone would do this job for a living is beyond me.

May 10, 201313 yr Author Not a good start to the day, especially when he bailiff on the phone started saying he had done 22 years service in the army, really pssed e off, anyway off to the CAB now see if they can help, I have sent a photo of the log book to the bailif to prove its not mine he says he can still take it though, I can see an ear water being dished out

I have had One or Two run ins with them in the past for Council Tax when the new tenant didnt change the name over Do not let them in the house, no matter how nice they are at first, Do not sign anything, They can only take your property when they have been into your house and taken a list of all the items that they wish to take and if you have signed it I had one bailiff telling me he was sending me to Prison. They are Jumped up bullys who deserve a Good kicking.

May 10, 201313 yr Wifey works for council tax as her other job and just asked. It all depends on whether your tenants were registered. If they were registered for council tax for that period at your property then they owe it. However it was your responsibility to inform the council at the time that you had new tenants and then inform them at the end of the tenancy. If they were not registered and the council tax remained in your name then unfortunately you will have to pay. hope this helps. Edited May 10, 201313 yr by bgoefc
