for the suarez argument, i presume suarez was done for using racist language directed at a player as an insult , and terry has been done for using racist language which despite the content is againt the rules.

 

and for the no guilty in the court of law argument he was found not guilty of not directly insulting a player following a public complaint.

The court had to prove he said it with racist intent.

 

The FA just had to prove he said the words and given that he admitted saying those words then he's bang to rights according to what the FA charged him with.

It would be improper for the FA to have their hearing with a related court case waiting to be heard.

The real question is why the CPS proceeded with the case when the chance of adequately proving guilt was limited and the likelihood of an FA punishment was significant.

As it happens Terry unlikely defence assertion in court demonstrated his guilt on the FA charge. But as I've said before it was Chelsea who applied for the court case to be deferred until the close season - the FA would rather have had the whole process completed during last season.
