Now, if H's tale is true, I get the feeling if KA got an adjournment on a technicality, I'm guessing the post boy at Walker Morris got a good ticking off for not properly signing for the letter or hand delivering it to an addressee....

 

I'm not an expert and happy to be proved wrong. 

I've not read the whole of this thread - is someone saying there a copy of a signed resignation letter somewhere?  Because if it's signed and dated, that would mean Ken's no longer a director of ICI and therefore no longer the owner of shares in Burnden Leisure, which would mean he's no longer a director of the club.  He's still in place so I'm not sure that letter can exist?

I doubt the club's got the money and the money ICIL has seems to be owed to the finance company. Ken's been in a cleft stick and has plainly received help that, quite rightly, he's acknowledged.

54 page document. Only Howard has been able to say when it was executed.

See appendix 2 part on on the link (page 50 or something). Signed, albeit tippexed out as they'll not put things like that onto Companies house in full detail.

The resignation only comes into effect on default and recall by Moonshift,  and the original will be kept under lock and key somewhere nice and safe.... Bassini is probably asking staff for the key to the safe as we speak!

The letter that's been posted can only be the Part 1 letter then?  For that to be enforced needs a signed and dated part 2 letter. Can't see Ken signing that any time soon.

Can't already be signed and dated.  From the point at which it's signed and dated it's enforceable and Ken wouldn't currently be a director of ICI or Burnden.

The challenge if and when we get back up is keeping those 6000 who disappeared between 2004 and 2008.

Interesting also the game vs Birmingham 1 year ago yesterday had 21,097 - higher than the 2008 PL average.  

 

 

 

 

I think if we could get back into the Prem and far up the table we could fill the stadium. But that obviously would depend on how much money the new buyer has and their ambition and their sanity levels.

Makes me wonder with Micheal James paying the wages if Basran is involved again

Would they need to give 14 days notice?

I can't see any reference to it, other than maybe in the definitions.

12.1/ 12.2 suggests it could be enforced without notice if in default

Anderson got a 7 day extension because he said he did not receive the notification, runs out 9/10th April.

Can be signed... the contract is dated and witnessed. I’m guessing it could be enforced without a date if all elements are done per the contract

Righto I've had a proper read of it as far as I am able to understand it.  So both are signed, Part 2 is dated and enforced when the lender takes action to recover debt.  So Howard reckons his boys have done this and will seize Ken's shares Tuesday next week. If the deal with Buffooni doesn't go through, I think this means Ken will only keep his cash by liquidating.  I wish I'd not read it now, who was it who said a little bit of knowledge is a dangerous thing. 

I think I need lots of San Miguel to beat back the depression.    Looking up in shock at 0-1 on the score board in Munich seems a bloody long time ago.

This is why KA sought the deal with Bassini and why he wasn’t originally going to contest the first liquidation. 

He DID NOT want the extension to the 8th May. 

ICI will be put in to administration on Weds 10th and as such BWFC will become a creditor of ICI to the tune of £13.3M. One would hope/assume that there are significant funds in ICI accounts that the administrators can access.

The gamble KA took was Bassini completing before the 10th so that he takes his payout and keeps the ICI funds.

I expect your team will know if they're likely to get in before the 10th. Presumably Ken will try to resurrect the deal with them if Bassini is not looking good?
