Subsequently on the same day, the Group entered into a Deed of Settlement with Blumarble Capital Limited that states that the company is due to pay £4m, plus £300k interest, by no later than 1st September 2018. Interest is charged on this loan at 10% per annum on a daily basis from the date of the Deed of Settlement. A further £700k will become due should Bolton Wanderers Football Club be promoted from the English Football League Championship to the English Premier League before the commencement of the 2020/21 English Football League Championship season and payable on 1st July in the year of such promotion.

What would have happened had he done nothing?

 

We simply would have gone into Administration - I believe Davies had already applied for it on the court day (when Holdsworth money partner withdrew) and had to withdraw it again when Anderson stepped in as Holdsworth's new partner.

 

As the major creditor Davies could choose the Administrator and so he would still have had a massive say in what happened next.

 

We would have had points deductions but on the other hand the Administrator would have been able to terminate some/all of the ridiculous contracts handed out by Coyle and Freedman in terms of length and wages paid that have (and still are) hamstring us to the end of this season (and in the case of Amos - beyond).

 

In regards to Holdsworth, lets be honest, anyone could get a BluMarble type loan, secured on an asset that wasn't ever really theirs (legally it was for a window of a few hours) and not have any plans to pay it back personally - remember the initial terms of the BluMarble deal was to pay it back within 10 days (iirc).

You can't just welch on contracts because you go into administration. Clearly the Blumarble deal was a bad un (probably the only one on the table). Personally I think it is positive that we are getting out of trouble without the need for administration.

Entering Administration is basically being pronounced insolvent legally - with the Administrator having use of legal powers such as termination of contracts.

The one concern is that KA hasn’t supplied any information about future investment and how we continue to trade going forward without that investment. Nor do we know how or when he plans to pay off the debt.

The Administrator can and does actually.

 

The Administrator has the power to terminate employment contracts (making people redundant without the need to pay redundancy - although the state will provide a minimum payment) in the event of an insolvency.

 

Entering Administration is basically being pronounced insolvent legally - with the Administrator having use of legal powers such as termination of contracts.

I have but the only recent high profile case where actual Administrators were involved - Glasgow Rangers (March, 2012) - there was a definite intent to 'sack' players if they did not agree to an immediate 75% wage cut.

I would have thought the SPL would have been similarly set up in respect as the Premier League in respect to the Football Creditors Rule - and thus based my comments up on the actual dealings of the insolvency Administrator at Rangers.
