So I take it that this means Bassini has failed in meeting the requirements?

The issuer isn’t the original owner

Who actually owns the shares?

I understood that Dark Horse bought the debt but the shares remained under contract to Moonshift until the debt was settled?

If so is calling in the debt which presumably Dark Horse are entitled to do, not the same thing in effect as triggering KA's loss of share ownership to Moonshift at the time the debt is defaulted on?

Did you not see this coming? It was inevitable. Ken knows there is no prospect of a legal battle during which the club survives. So what now? Someone either deals with Ken or club goes to wall. Game of chicken. And I seriously hope its a case of nobody blinking.

Burnden Leisure own the shares, ICI own Burnden Leisure.

does that mean he can stop it happening, or that for now, it happens and he can see us in court if he wants?

Surely the terms of the debt and all the legalities of it would go to Dark Horse on their purchase of it from Moonshift just the same as if Moonshift had kept it?

p.s. I'm not really a noob,  lurked for a long while and decided to finally post

Belief that he should be informed of the novation of debt with the right to challenge

Would it have not been in KA's interest to challenge this immediately when he learned about the Dark Horse/Moonshift deal, if he thought he'd have a chance of winning it, instead of weeks later?

Sounds like a KA delaying tactic to me.

This is ridiculous people playing games with the future of our football club, surely someone should be able to step in here and sort this mess out. If he's agreed in principle to the deal then let's do it. Ken is starting to get right on my tits now, it's time to pack up and go, your just being a greedy bastard. I hope he gets fuck all
