Yeah that does sound really dodgy, surely he should be getting at least the five weeks pay as he’s still employed at that time? Either way, bit of a shit thing to do. 

That is WELL iffy.

He needs to tell his employer that it’s wrong and start some dialogue, preferably in writing.

He needs to start building a case right away. Don’t wait.

The bit I don't get is whether the employer has actually done anything wrong.  Ethically yes, but legally I can't find any info.

You're right about the dialogue but depends if he wants to piss him off and risk never getting his job back when the business re-opens.

Plenty of time for him to find a new job I guess!

Ok so forget the furlough bit as that has muddied the water in your thinking. 
 

He is in essence being made redundant here. But retrospectively. 
As such he is protected by the laws around this. He needs to be given suitable notice and his employment contract will be key here. Also he needs to be paid upto date and then paid his redundancy pay also  

you cannot just turn round to someone and say oh by the way I made you redundant 5 weeks ago forgot to tell you.
 

So your mate is actually in a really strong position. Citizens advice and or a free consultation with an employment lawyer.

Problem is, he's going to struggle to get anything out if his employer but might be nice to dob them in to HMRC

But it'll be bridges burned

I think the point earlier to ask for a P45 might force their hand if they're up to no good

 

Found out yesterday that those responsible for it at our place have still not managed to submit the furlough claim, surely you just collate all the details, log on, and fill it in ?

We all got paid regardless so it's ok from that perspective at least.

They just might not be in a massive rush to claim the money I guess, from what I've heard it's a fairly painless exercise claiming the money

Not quite furlough related but I did my self assessment to claim my tax relief on my business mileage last Thursday. Money landed in my account today from hmrc. I am amazed tbh as thought they would be swamped.

Just seen the letter and P45.

Letter dated 28/4/20 saying employment terminated from 25/3/20, thanks for hard work etc., terminated due to lack of work due to lockdown, look forward to you returning to work when business recovers, P45 dated 25/3/20.

No mention of any notice period, holiday pay due.

So on PAYE for 6 months ish, laid off with no furlough and expected to go back!  What employer would do that, even if he just paid the furlough 80% that he would receive, surely that would have been the answer?

Well, it doesn't sound like his boss is on the fiddle, but it's extremely shitty.

One for Citizens Advice probably.

He should set up in opposition when it blows over, undercut the c*nt...

Those who don't want to apply to the furlough 80% scheme likely have sommat to hide an' all imo.

There should be some blacklist of firms who've acted the c*nt during this I reckon' - though most folk probably will still go for the cheapest regardless.

I'd guess the employer has no intention of taking him back, even if your mate was willing to return

The failure to pay him holiday pay and notice is a breach of contract...assuming he hasn't paid it, that is

Did he work until termination date?

Also, it's a while since I've done this, but 99% his termination date can't be weeks before he gets told he's going

Potentially, there 4 - 6 weeks wages to be had

 

If it was me and I didn't want to go back to the job, I'd start with a call or email to ACAS

Got straight thro to ACAS and they said 'no respective termination' and furlough should be the option taken.  She said an employment lawyer would love this one and to get in touch with one asap!

I'll take a step back now as one of my funders is mates with the owner and I don't want to piss him off!

Ours who are on furlough just got a letter saying it had been extended until the end of June, its looking very grim out there at the moment.
