Thought I'd post up this conversation we've had over on Nuts that may be of interest.

Note - The poster Rammy has a background in accounts.

Rammy in reply to a post showing what KA said to the FGR owner about him not being bothered by a Winding up order because he was a secured creditor.

"Pointless quote from him as he may be a secured creditor but in the hierarchy of secured creditors he's below HMRC, any wages owing, any lender with a prior or senior charge on specific assets. Add to that - as creditors are paid in cash, and there isn't any- he won't end up with much.
Apart from being a shyster who brings shame on the club, he's kidding himself".

My question to him -

"Would he be a football creditor though?

If so wouldn't that put him at the top of the pecking order at a football club entering Admin/being wound up?".

His reply -

"I would guess not as I think that category of security would be limited to other football clubs for transfer fees and the like, footballers wages, contractual bonuses and then loans from the football league.
He's a shareholder/investor and although he may have given himself  some sort of charge on some assets (which ones, I don't know but I can't imagine there are any left) he wouldn't be classified as a football creditor.
I'm not sure of the specific law on this so I may be wrong, but I would guess that he's way down the pecking order when it all finally collapses.
Which I think will be  sooner than expected!!".

Maybe if that is the case and KA knew he was likely to not get much back as even a 'secured' creditor, then maybe KA said what he did to the FGR owner more in bluster rather than smugness, and maybe he's about to lose the club to Moonshift without much to show for his efforts over the last three years as I for one was assuming he would be.

I've no way of confirming that Rammy's opinion is bob on but it does give a slightly different slant on things (although I think the vast majority have already made their minds up already).

He would have done what's best for the club.

Like leaving that bit of money in, when he first sold the club.

I just hope that those who have previously trashed Ed's name, think again- should the club default back to his family's ownership (as sluffy suggests it might) we may need them to act in good faith, and not in a "fuck them, the ungrateful bastards" sort of way.

Everything is guesswork really, as so much of what's gone on doesn't make a lot of sense with the information we have (like Eddie giving Ken £5m if the likely outcome was that Ken would get some of that back and Eddie would be left with ownership of a club he'd just given away).

I mean, if the scenario above is correct (that Ken would be behind football creditors) that would actually put him behind FGR in event of the club caving in. Which is the exact opposite of what he said to their chairman, so maybe there's more to it. 

Should we ever get to file another set of accounts, that might clear quite a bit up.

The Davies family have little desire to have anything to do with the club.

When Eddie first took ill and he gave power of attorney to this sons, it was at that point the Davies family refused to put another penny into the club, resulting in the original HMRC issues. When Eddie recovered and took back control of his finances etc, he then brokered the deal with Holdsworth and resumed being a backer of the club.

I can't see the Davies' wanting to run the club.

No possibly not but a new owner is more likely wth KA out of the equation.

Not that it’s definite by any stretch of the imagination but NB confirmed to me yesterday KA bought the club for around £150k and so far as of yesterday had invested circa £2m of his own money. Outside of the money lent then secured against the club 

so when he refers to “his money” you could strongly say it is this. 

As said above by someone else, I’ve backed him. Not backed him personally but whichever unfortunate fucker was responsible for trying to navigate us out of this shit and avoid admin at all costs had my support. In spite of his dodgy ness, upsetting all and sundry, antagonising any one he came in contact with. Because for me, it was A means to an end. Safeguarding my club. However he went about it didn’t matter. 

I bought in to his words, his statements about doing what was best for the club. But, slowly but surely it’s started to unravel and today demonstrates everything about how he actually feels. 

I was wrong. Not wrong for backing someone who was trying to save the club. Wrong for believeing that Cnut was the man to do it. 

Do I want admin like these other clowns? No. I also know I don’t want him. What’s the solution? I have no fucking idea

Feel exactly the same, where we go from here is anyone's guess. Looks like he's just give up on it, anything can happen from here, seat belts on I'm afraid

BC- maybe he could take a back seat, bring in a board and get the club running in the sort of way he says he wants.

Perhaps this would allow the club the regain some credibility, who knows.

Obviously, this would mean more wages, but we could perhaps save that in letting go more loanees or short term contracts.

Fuck knows.

unless its cashflow and it could still be, theres no money to run the club til the end of the season so you can put in any board you like

without cash, they wont be able to do anything

Best thing Dale Vince FGR Chairman could do, would be to ditch FGR (poulation of Nailsworth is 5700) and buy us with his £100m wealth.  Not a billionaire but would see us through this dodgy patch.  Mind you Carrs pasties and Bovril would be fired off.

For balance, regardless of what he values the club at no fucker over the last few years who have shown an interest has apparently provided proof of funds. Why he would lie about that if it wasn’t the case I’ve no idea 

he’s probably sat there thinking the same. “What’s the options? I’ve no fucking idea” 

he wants rid as much as we do. It’s a lose lose situation if he walks
