Is there a course or is it just straight to 6 points?

The single most annoying part is that I wasn't even on the phone.

I was stationary, literally passing it to the lad I work with as we'd had a missed call. Even showed them my call log.

Specifically making sure I wasn't on the phone while driving.

In my had is enough though,

I wasn’t using my phone whilst driving – how can I challenge the offence?

If you do not believe you committed the offence in which the police allege, you have the right to have your case referred to the Magistrates Court to deal with. You would then have the opportunity to challenge the case at court.

The prosecution have to prove beyond reasonable doubt that you were actually driving and using the phone. For example, a police officer will give evidence to say that he or she seen you driving whilst holding a mobile phone up to your ear. The key to cases of this nature if to put some doubt in the mind of the Court to try and obtain a guilty verdict. We can also obtain your call records from your telephone provider to prove you were not making or receiving a call.

If the prosecution think that they may not succeed with a mobile phone offence they can always lay an alternative charge of not being in proper control of a vehicle. In addition, in cases where the police think you are being distracted by a device whilst you are driving but you are not touching the device, you could still be stopped and prosecuted for not being in proper control of your vehicle. This offence carries a lesser penalty of 3 penalty points and a £100 fine.

Depending on the circumstances of your particular case, the prosecution may also be willing to lay this alternative charge, which in turn would result in a lesser penalty and even avoid a disqualification from driving.

I thought it had changed recently but according to this, need to be using the phone interactively.
being stationary doesn’t matter, can still be deemed as driving 

check it out and see if it’s worth challenging , someone got away with using it as a video  because that’s not deemed interactive.

its nothing to do with making a call. Logs will prove nothing.

In the text of the SI, the meaning of ‘using’ a phone will be expanded to cover the following: 

  • Illuminating the screen. 
  • Checking the time. 
  • Checking notifications. 
  • Unlocking the device. 
  • Making, receiving, or rejecting a telephone or internet-based call.
  • Sending, receiving or uploading oral or written content. 
  • Sending, receiving or uploading a photo or video. 
  • Utilising camera, video, or sound recording. 
  • Drafting any text. 
  • Accessing any stored data such as documents, books, audio files, photos, videos, films, playlists, notes or messages. 
  • Accessing an app. 
  • Accessing the internet.

Missed call was from much earlier.  It wasn't recent.  It was a case of "we missed a call earlier pal, give them a bell back" - Hands phone over to colleague.

They say it was in my hand tough shit.

Same. I’ve have my phone in a holder clipped into an air vent. Makes me wonder if I could get done for touching the phone in that as the media system is a fucker to work

If it wasn't true it would be fuckin funny! 

There's no course as an alternative so it's a choice between taking what they give you or fighting it. 

I'm not sure if pepipoo have advice on this as well as speeding but you might even be able to say you were passing a mars bar over to the passenger if there's no evidence otherwise.

Expect cost ends up being the deciding factor overall.

Quite. I mean adjusting air con in the current weather means you take your eyes off the road for a brief bit. Even the sat-nav shouting some instruction that's wrong or confusing grabs your attention.

If you plough into the back of someone because you checked your phone I'm 💯 sure they'd be able to do you. 

If you prove you didn't unlock your phone whilst you passed it to van lad you'll be alright.

The irony is that if you had it linked to Bluetooth you’d have probably done a lot more twatting about but not broken any way.

That said, the recent rule change about even touching your phone while driving was fairly clear IMO. Although it seems to have made fuck all difference judging by the amount of people I saw holding the phone to their ear or, worse still, texting at 70mph on the A55 earlier.
