Mounts Kipper
He lost But he still had a case This isn't open and shut I agree and I think it's 50/50 which way this goes if I was having a bet I'd think some of the accused will be found guilty. birch-chorley
My understanding is that McGill was proved right but as he had nothing in writing he was up shit creek
Guest Blixa
McGill is going to end up bankrupt. Sounds a bit like a courtroom version of poker. You lose heavily or you win big. Edited January 16, 2015 by Blixa
Site Supporter MickyD Posted January 17, 2015 Site Supporter Share Posted January 17, 2015 It could be brief? Will PG wear a suit?
Rembrandt
Less burden of proof in a civil case, isn't there ? Â Not good for the club whichever way u look at it.

Traf
Testifying in court really isn't his cup of tea. Somebody ought to give PG tips.
RoadRunnerFan
I think PG might need to offer more than a monkey as a bribe to get out of this one.

Moderators Casino Posted January 18, 2015 Moderators Share Posted January 18, 2015 So if I've got this right the 'system' doesn't have any reason to suspect these blokes have perjured themselves, otherwise this would be a criminal case at crown? Moderators Carlos Posted January 18, 2015 Moderators Share Posted January 18, 2015 I can't work out what a private prosecution for perjury actually is, and indeed if this is even possible.
Astley White
So if I've got this right the 'system' doesn't have any reason to suspect these blokes have perjured themselves, otherwise this would be a criminal case at crown? My understanding is this is a criminal case which is being heard at Newcastle Magistrates Court. It may then be committed to Crown Court if it goes any further than the first hearing. Moderators Casino Posted January 18, 2015 Moderators Share Posted January 18, 2015 It isn't a criminal case It is a civil case brought by McGill
Astley White
Okay...as it's a private prosecution if there is a case to answer when Gartside and co. attend court, the Crown Prosecution Service could still take the case which could effectively make it a criminal case. Any lawyers on here will know?
Site Supporter MickyD Posted January 18, 2015 Site Supporter Share Posted January 18, 2015 (edited) Perhaps he has new evidence that proves the perjury but the CPS has no desire to send it to court such is its frailty.
