Wanderlust Posted July 29, 2019 Posted July 29, 2019 One thing about FV that doesn't impress me is that they appear to have a business plan that will only stand up if they acquire the hotel - yet they agreed HOT to buy the club without taking the necessary steps to ensure that the hotel came with it and within the budget they have available - hence all the delays. Surely they must have foreseen that if they made one commitment without clausing it as dependent on the hotel deal at an agreed price they were fair game to be held over a barrel by someone like Anderson? There's no way they should have agreed to buy the club on that basis. Can't decide if they are stupid or naive - or both.

There is no commitment to complete the purchase.

Maybe we're not seeing the full picture but I have to agree, from what we know it seems like utter incompetence. Personally I don't think they have the money and they've been trying to do an Anderson by robbing Peter to pay Paul.

This succinctly describes the predicament. HOTs were agreed between A and B, but it was always conditional on C agreeing to a deal. C have a duty to get the best return for their creditors and know that they can exploit A and B to maximise a return. Ken has cross collateralised / secured every debt he is owed, to maximise protection and security. Very savvy, but as owner of all the companies, it was within his control to do so.
